DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement ("Agreement") is established electronically between the parties whose information is provided below, in accordance with the provisions of the Consumer Protection Law No. 6502 and the relevant Distance Contracts Regulation.

2. DEFINITIONS

MINISTRY: Ministry of Trade

SELLER: A person or entity acting on behalf of or in the name of a commercial or professional activity, offering goods to the consumer
BUYER: A natural or legal person acquiring goods or services for non-commercial or non-professional purposes

3. SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the parties regarding the BUYER’s purchase of products belonging to the SELLER on the website www.cappadivine.com.

The type, quantity, brand/model, color, number, sale price, and payment method of the products are as specified in the invoice and product detail screen approved by the BUYER before placing the order.

4. SELLER'S UNCONDITIONAL ORDER CANCELLATION RIGHT

The SELLER has the right to unilaterally and unconditionally cancel the order in cases such as the product being out of stock, not being able to be supplied, production being stopped, or errors in price or description. In such cases, the amount paid will be refunded to the BUYER within 14 days after the cancellation notification.

5. ORDER AND PAYMENT

The BUYER acknowledges that they have been informed about the product(s)' basic features, sale price, payment method, and delivery time. The total amount specified will be collected using the chosen payment method once the order is completed.

6. DELIVERY

The product(s) will be delivered to the BUYER's specified delivery address, within a maximum of 30 days, depending on the BUYER's location. Deliveries are made through contracted cargo companies.

7. INVOICE AND TAXATION

The invoice will be created digitally according to the invoice information specified during the order and sent by email, or delivered physically with the product. All prices include VAT.

8. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 14 days from the date of delivery without giving any reason. To exercise the right of withdrawal, the BUYER must notify the SELLER in writing within the specified period.

Returned products must be unused, unopened, and in resalable condition.

In case of withdrawal, the return shipping cost shall be borne by the BUYER. The SELLER will refund the amount paid by the BUYER, deducting the return shipping cost, within 14 days after receiving the returned product.

9. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  • Products prepared according to the BUYER's special requests (e.g., personalized jewelry with name engraving)
  • Products unsuitable for return due to hygiene reasons (e.g., earrings)
  • Products that may spoil quickly or have an expiration date
  • Products whose packaging has been opened after delivery

10. DEFAULT

If the BUYER makes payment by credit card or similar payment methods and the payment is not completed or is canceled, the delivery of the product will not be made. In case of delayed payments, the credit card agreement with the bank is valid.

11. DISPUTE RESOLUTION

In case of any disputes arising under this Agreement, the Consumer Arbitration Committees or Consumer Courts in the BUYER's place of residence, within the financial limits determined by the Ministry of Trade of the Republic of Turkey each year, shall have jurisdiction.

12. EFFECTIVENESS

The BUYER is deemed to have accepted this Agreement with all its terms when they place an order on www.cappadivine.com. This Agreement comes into effect on the date it is electronically approved.
